Program Description:
hewitech makes the calculation program „Calculating Performance of Cooling Fills“ available on his website free of all costs and charges. The calculation program shall serve as a resource for the calculation of ideal values for the performance of cooling installations and it shall be for informational purposes only. It is not suited or intended for the design of cooling towers or cooling installations.
Conditions of Use:
The results and information obtained from using the calculation tool are dependent on the data used and inputed by the User. The User alone shall be fully responsible for their accuracy and completeness. It is the own responsibility of the User to review the results achieved by using the calculation tool. Making the calculation tool available does not constitute technical advice from hewitech nor does is replace the need for such. It does not create any contractual obligations regarding the manufacture and/or delivery of goods and/or services by hewitech and serves neither as an acceptance of contract negotiations nor as an initiation of such a contract. In no event do the results obtained by using the calculation tool constitute warranted characteristics or contractually agreed upon specifications.
The liability of hewitech to the User for material defects and defects of title is limited to fraudulent concealment of any defects in the software. In this case, hewitech is obligated to compensate the User for the resulting damage. In all other respects, any and all warranties on the part of hewitech for material defects or defects of title regarding the software shall be excluded. In no event does the User have claims against hewitech for correction of faults.
hewitech is only liable for damages for willful misconduct or gross negligence. hewitech reserves the right to any claims for contributory negligence. The User is obligated to back up data and protect against malware in accordance with the current state of the Art.
The calculation tool is legally protected. Copyrights, as well as any patents, trademarks and all other ancillary copyrights on the software belong exclusively to hewitech. In the event of third party claims, hewitech shall have the appropriate rights of exploitation. hewitech grants the User the necessary authority for a simple, non-exclusive and limited right of use of the calculation tool for its intended use in accordance with the program description, lasting the duration of access to the calculation tool.
The User shall diligently test the calculation tool before and during use for usability in general as well as for its suitability for the User’s intended purpose. The User shall take reasonable precautions against improper or partially improper operation of the program (i.e. through data storage, malfunction diagnosis, regular examination of the results, emergency planning). It remains the sole responsibility of the User to ensure the functionality of the working environment of the program.
